Author: HotWater It has come to my attention, that this past week, the first of possibly many depositions of Mr. Ed Dickens, Jr, took place, involving the sexual harassment lawsuit. Obviously, it didn't go well for Mr. Dickens!
Subsequently, there is now a "movement" in Omaha to fire Mr. Dickens, and bring back the previous Foreman General, Mr. Henry Krenning, who is still an employee of UP, and is the person bringing the second lawsuit against Mr. Dickens. Mr. Krenning would be give full support, as DIRECTOR of the UP Steam Shop, to fire & hire persons OR sub-contractors as necessary. Reportedly, these changes could take place in September, 2014. The more i dislike him. He is a good guy to talk to. But he isn't the best guy for that position. Yes i respect him. Yes he made some REALLY BIG unforgettable mistakes.

I neither know or support any of the participants involved,nor have any interest in UP affairs. That being said I have to wonder about UP's motives in the possible offering one of the litigants a promotion,and into the position currently occupied by the other party. Is it a quid pro quo? A payoff? I am not inferring the party is not completely qualified,and maybe should have been in the posistion from the beginning,but why now? Just the way it was reported here,and only knowing what I read,makes me wonder what is going on behind the scenes,and why.

One of the uses of sworn depositions is to 'challenge' the witness during the [potential] trial. Often, what's said on the 'stand' [may be under a lot of pressure] contradicts what's recorded in the depositions. The trap has been sprung.... "You stated 'A' on page s-&-so of the deposition: NOW you've told the jury that what happened is 'B'. Which one is the truth?" There is often a LONG time delay between the depos and any trial --memory tends to fade about what reaction & wording was recorded at the time of the depositions. SOOOO... depositions in themselves are relatively harmless----when the lawyers, at trial, smell blood in the water, THAT'S when the depos really can be the "torpedoes below the waterline" for the defense. As time and events unfold, its common for a settlement to be reached before trial. And, the Company lawyers may decide to recommend & seek an out-of-court settlement. The Plaintiff's lawyers are probably very sure of their outcome(s) EVEN before launching their suit I doubt if this is their "first Rodeo..." involving the U.P. RR. I'm just sayin'... Wes C.
