UP settles lawsuit

Just thought I would point out that on the Wyoming Tribune Eagle website there is a new article stating that UP has settle the lawsuit with Carolyn with the Harrassement issues she had at the steam shop.  You can find the article at www.wyomingnews.com.  This should be a good popcorn moment.

You don't settle after judgement in your favor unless you are scared of the appeal.

Sooo....does this mean UP will terminate Ed Dickens?  I can guarantee you if the company I worked for had to settle a lawsuit due to my actions (which basically means they have found things that I was not 100% in the right about), I would be terminated.

Any predictions on that front?

They won't touch him.  Yet.

Another suit is still very much active.  UP has filed
twice to have that one dismissed by the judge, and been
turned down both times.

If they lose that one, look out.

I agree, someone must have been scared to death that
her appeal would be heard and granted, and UP's FRED
would be hanging out if that happened and the case actually
went to trial.

a lot of companies settle a lot of things due  to the cost

terms wern't disclosed is common

But they had gotten this one dismissed.  The only
reason they would come back and settle is if they were
scared to death of what would come out in court if
she won her appeal and the case had to go to trial.

They were in deep doo-doo because of him and they
knew it.

They still are.

I remember it being floated the judge, who dismissed it had a conflict. Maybe there was something to that..

I've never had the feeling that UP would kill the entire steam program more than I do at this moment.

You have reason to fear that happening, with the down turn in business and stock. Shelving the program for a short or long period of time can't be ruled out. It boils down to alot of money being spent and NO results to show for that money other than taking things apart for the hell of it and replacing good parts for genuine bad parts. The poor 844 is going to be so dear leadered it will never steam up properly again until its completely fixed all over again, if it ever runs again. They might as well send the 4014 back to Pomona because time is running out for its restoration. Right now the 3985 is in the best shape due to the fact the DL hasn't run her or touched her mechanically since he took over, other than destroying the super heaters.

Do you mean to say that UP won't show this guy the door until they settle TWO lawsuits against him?  

Settling ONE isn't enough?  

He must REALLY know where the skeletons are hidden that some of the higher up want to keep under wraps!

If I was Mr. Krening, I would hold out for a jury trial,  although a seven-figure settlement could get me to shut up. Whatever happens, this should spell the end of ED at the UP;  hopefully not the end of the steam program.  THis guy has been toxic from Day One,  although the chickens are getting close to roosting in Cheyenne.

Knowing Henry as I do, that is EXACTLY what he wants to have happen, since the current manager has told so many untruths, and tends to lose total composure & control when confronted with true facts, the desire is to have have him "lose it" in front of the Jury.

Maybe Trains Mag can produce another video of 4014 being towed back to Pomona :-)

Congratulations to Carolin on getting some justice.   Lord knows whatever she got was not enough for putting up with all of this.   At least now she can go back to a normal life.

Henry is a good friend and I support him 1000%.   Carolin's outcome helps make his case stronger.   I hope to attend a jury trail, but if Henry decides to settle, I'm ok with that because He is what is important here.   If he does, I'll be happy to drive out for a "Safety Meeting" at Uncle Charlies - but he's buying !

There is one wild card to the whole shut down scenario that won't be lost on U.P. - Wasatch Railway Contractors with their Operations Manager Steve Lee are a few blocks away.    If anybody can salvage this mess, they can.   Not a bad plan B.
