I'm sure we'll get an OSHA comment here.

What does OSHA have to do with FRA operating practices?

Weren't they the originators of the "puke-green" vests?..

Why would OSHA have anything to do with what's going on here! This is classic railroading
at it's SAFETY BEST! And we don't wear Yellow Vests when in Uniform as per the GCOR!
Holey Moley there's always someone out to cause trouble!

And lets hope it stays that way. The vest situation is out of control in the U.K. On the IOM Steam Railway,  anyone on the ground off a station platform (excluding the train driver) is required to wear the hideous orange things that show up in all the photos. Even most people walking their dogs wear them as do kids riding bikes. Totally unnecessary and they ruin the historic appearance of the railway. It's almost impossible to take a photo of the 611 without a yellow vest in the shot. I don't recall seeing any in Mr. Link's photos and having read of anyone dying as a reslut.

Really, I wonder what the FRA would have to say about only whistling for the crossing 4.75 seconds before reaching the crossing.

Nothing!

It's clearly marked as a private crossing.

Report card:

A+ to the valve setter!   She sounds every bit as good as I remember her when riding her the northwoods of Minnesota half a century ago.

A to the engineer

C- to the fireman.  Why is (s)he makin' all that black c***?

A+ for rules compliance.  Unless there's something unique and specific in the F&W ETT that I'm not aware of, there is NOTHING in any of these pictures which would indicate noncompliance.

Nice photos and video. Had I not been hiking I would have been there.

Was attendance good? Also any new information about the county's action against the rr?

In order to put all this nonsense to rest:

Yellow/Orange Vests are not required for Passenger Conductor's or Brakeman while in uniform. This is per the GCOR!

The Fireman was making the Smoke Black for the benefit of our passengers during the Run-By's! The rest of the time He/She was running with a pure clean stack!

The Whistle blowing at the Private Crossing (Farm Crossing) was not required account the crossing was "O.O.S." Note the cable across the dirt road, the closed gate and all the people standing in the road! Plus for added Safety we had train crew personal protecting the crossing. So blowing the Whistle 4.75 seconds (at 15MPH or less) from the crossing was for the benefit of our passengers filming and taking photo's and not required per the rules! (see below GCOR 5.8.5)

I posted these pictures/video for the enjoyment of all who love Trains and Steam. I didn't think they would start a debate of what's a violation or not a violation! I have 42 years as a Conductor/Brakeman on the eSPee and Licensed as such per the FRA! I/We don't violate rules! Hopefully I answered some questions and the debate can be put to rest!

From the 7th edition of the General Code of Operating Rules dated April 1st, 2015:

5.8.5 Silenced Whistle
Whistle signal (7) is not required when approaching a public crossing at grade when:
* Permanent maximum authorized track speed is 15 MPH or less,
* Active grade crossing warning devices, if equipped, are operating as intended,
     and
* Crew member is on the ground at the crossing to provide warning until crossing is occupied.

Note: Whistle signal (7) is 2 Long, 1 Short, 1 Long.

(I was going to post many more pictures from our Railfest 2016, but with all the scrutinizing of these pictures, I don't think so!)
