Horrible accident. May the victims RIP.

Not clear from the story what car they were in. Perhaps the gondola pictured? They keep showing the pipe cars, but also keep referring to steel beams which are clearly different than pipes. My guess is in the gondola.

Pretty horrific, but as we all know - when you engage in dangerous behavior, dangerous things can sometimes affect you.

As an aside: Assuming the beams were not damaged with the shift, how could this effect the delivery of the product to the customer? A delay of a couple of days would be expected, but other than that? ANyone have any insight as to what gets communicated to the shipper? I would think if the beams are undamaged, they will eventually get delivered and used for their intended purpose. Kinda gruesome, but can't see any reason to do otherwise.

Right now, the beems and car can't be moved to the receiver until the investigation has been completed as the car is deemed evidence. The police may release the car if they deem they no longer need it to finish the investigation.

Horrible for the crews and emergency folks dealing with it...the hell with the tresspassers. The world got a bit smarter with a few less people on the shallow end of the gene pool and a bigger lessoned learned (hopefully) by everyone watching TV.

RIP for the deceased, and condolences to the crews, first responders, etc who have to deal with this completely un-necessary and senseless mess.

What is troubling to me is that the deceased could be someone's father, son, brother and etc.

The comments are priceless on that story... "Haven't the survivors been through enough? Please don't charge them, but give them some money to help." Whoever that poster is acts as though they just witnessed the holocaust.

Wow... never mind that they were breaking the law. Laws that are put in place to prevent tragedies like this, but let's reward them for breaking the law and testing the purpose for which it was written.

I'm not gonna suggest rewarding the survivors but I'm also not gong to condemn them like they murdered somebody. It was a freak accident that happened while they were trespassing. Doesn't mean you as an individual have to be cold hearted. It just shows who people are truly inside. I'm not referring to you personally, more of a generalization for anyone who feels that way.

There's been a gradual shift among some Americans toward focusing on --outcomes-- rather than the --choices--, conscious or otherwise, that got them to that point. It has reached the point that some court cases are presented to acknowledge that shift in attitudes among many prospective jurors. Somebody has to pay for this terrible result.

NJ had a case like that in 2005 when a kid won a large judgement against NJ Transit after he climbed on the roof on a rail car and touched the pantograph. The horribly burned, crippled 16 year was the focus, rather than the choices (drinking, engaging in extremely risky activity) that led him to the roof of the car.

Dont preach about how each one of us views this. I made no comment saying who's right or wrong, cold or not, blah blah. Yes it has happened to me, though not railroad related. Boating accident. Speak your views here, and read, not criticize the others. I feel sorry for all of those involved, families too. But to the ones it happened to, nope. And just think...its only a matter of time before the lawsuits roll in. Gotta love it.

Nobody is "preaching" to anybody. They and I are expressing our views and opinions. Just like you right? Right. You were to busy trying to be abrasive... Lawsuits or not. Highly doubt CSX will be faulted...

That's kinda where I'm going. I guess I could understand if CSX chose not to file charges... but to be honest, best thing that could happen to them would be to get thrown in jail anyways. At least for a couple days they'll get food and a warm bunk.

But throwing them a check because they witnessed the tragic end of their comrades is a bit over the top.

That would be a bad precedent. If we went to that level of compensation, would the survivors of a deadly automobile accident also qualify for a check for what they saw too? To lighten the issue, would it evolve down to the level of the viewers of the Kardashians getting a check for having to see Bruce Jenner on the screen;-)?

Exactly right. This shift started way back, shortly after the second person in any given state hung out their lawyer's shingle ;-)

Also true in the political world, some look at how much the politician cares about the problem, instead of what (s)he is doing to ease or solve the issue.

People I know and love wouldn't be caught dead in this situation.

You know darn well there's some attorney out there who will gladly sue CSX expecting an out of court settlement. Or get it to a jury and likely get some big money, as some previous posters said, it isn't about the illegal activity that got them killed, it will be about how the big bad corporation somehow caused those poor innocent transients' deaths. Heck even on TO you can see pity for them, so imagine a jury pool. I'm with KV1 on this topic.

I'm not into the legal side at all.
I think 99.9% of lawyer's are snakes. My opinion was from a morality stand point only. I strongly disagree with anybody getting a settlement for getting hurt/killed while trespassing or for even witnessing it for that matter.
