A smart move on their part. Perhaps it will keep the proverbial camel's nose (re. U.S. Congress) out from under the proverbial tent. The industry should be so lucky.

Yes A good offense is probably the best move in this case. Making DOT-111A tank cars the only approved carriers for the most volatile crudes would probably be helpful, too. There are lots of places (Eagle Ford, Utica, etc) where crude is generally much less volatile. Phasing out older or unshielded cars over five years would probably be a good idea, too.
