There are a few fixed points that have already been agreed to. Can't change those.
--Amtrak agreed it was responsible, and it's the only party. Has he been charged with anything yet in relation to the deaths caused by his error?

You could easily assert that Amtrak chose not to install a simple code change to manage cab speed, to spite of alleged operator error or malice. And failed to take this reasonable and simple step. There's likely some email or analysis which recommends this change. The Pope has come and gone, so Philly is less concerned with preserving its belief that it's the city of brotherly love and there were no shots or projectiles, etc. Those rail tapes would undoubtedly emerge in the engineer's assertion that his condition had been affected by the radio discussion of shots fired, other trains hit, etc. Date: 10/27/16 14:15 Re: Amtrak will pay out 265M for Philly derailment Author: joemvcnj Amtrak's conscious decision not to put in a speed code on that curve eastbound, but did so westbound, looks pretty negligent, regardless of what happened to the engineer. What is even more ridiculous is that NTSB's final report skipped the entire ATC issue altogether, while they knew better.
