That is an interesting point. Would the product producer have any liability here? I would think the railroad would be the one with the liability. GREAT question! This type of derailment (in area's were flooding has occured or is ongoing) has happened too often in the industry. BNSF will be asked why this type of train (crude oil) was allowed to proceed, especially if there were flash flood warnings issued. Allen |
