Excerpted:

FORT LUPTON, Colo. — The Fort Lupton Police Department on Friday released some video showing the moments surrounding the crash where a patrol car that was parked on train tracks with a detained woman inside was struck by a train. The video is eight minutes long and contains edited portions of clips released by the Fort Lupton Police Department after 9NEWS filed a records request.

The full clip that was provided can be viewed below in its entirety.Yareni Rios-Gonzalez suffered numerous broken bones when the patrol car belonging to Platteville Police was hit by the train on Sept. 16 near Highway 85 and County Road 38.

The video released Friday shows she was in the car for about two minutes before the car was hit.Video also shows two officers looking through her truck as the train horn can be heard blaring. As it gets closer one of the officers realizes the patrol car is on the tracks and begins yelling.

Some of the video released shows the moments when police pulled over Rios-Gonzales who was a suspect in an earlier road rage call and placed her in the police patrol car on the tracks. In that portion of the video, Rios-Gonzales appears to comply with officers' requests and respectfully answers their questions.

The released video also shows officers searching her vehicle. At one point it's noted that a "round" is found near the driver's side door and a gun holster was found in the vehicle. Just before the video provided to 9NEWS ends, an officer searching the vehicle is heard saying, "there's your gun."

Talk about gettin' nailed twice.  Attorneys gonna have fun with this one.  Might even become a law school case study.   Speaking of the latter, I remember a 1920s case of a towerman suing his employer,  the MKT.  Seems he was entertaining a lady in his tower and the swivel chair broke causing injuries.  He lost the case as the court (TX Supreme) held the activity causing injury was outside the scope of his employment.   Funny how one remembers such cases.

They are on administrative leave and may be brought up on charges. Meanwhile, the local DA has not decided on charges for the lady for road rage. They did find a gun and shell casing in her P/U.

"Why am I being arrested?"
Is there a weapon in the truck? "No".

Turning off of a four lane highway with a full width shoulder lane where it was safe to park to stop just feet over the crossing then playing innocent and lying to police officers. Sure, she didn't deserve to get hit by a train but miss innocent made several bad decisions before the incident. Watch the whole video in the link ... not just the moment of impact.

But the people who “serve and protect” made a far worse decision than she ever did.

Threating other drivers with a gun? The gun and shell casings found in the vehicle? Shell casings come from firing a gun.
The police officers lost situational awareness. She performed intentional acts of violence. A far worse decision.

Still innocent until proven guilty! These cops FAILED horribly plain and simple. I watched the video, they had more then enough time to move the cop car either right after handcuffing her or putting her in the back.

When a felon's not engaged in her employment
or maturing her felonious little plans

Her capacity for innocent enjoyment
is at least as great as any honest man

even worse is the crew van transport company's, my carrier has used, pulling up and stopping on multi track crossings, to get us to a train, I've yelled and chewed them out, trying to explain how dangerous their actions are, freight 50mph, Amtrak 79 mph, the train always wins.

The suspect's acts were intentional. She wanted to harm or kill someone.  Unless proven otherwise, I don't think the police officer's actions fall into the same category. Incredibly stupid, yes. Intentional? I don't think so. So no, he's not kidding.
