Amtrak 29(10) strikes dump truck in West Virginia

Noticed this one because I have a friend on the train.  Reports are that the Capital Limited struck a dump truck today (Dec 10) in Bardane, WV, which is just west of Shenandoah Junction.  No injuries were reported. Train has been listed as in service disruption since about 5:30 Eastern time.  Apparently CSX is bringing an engine to tie on and take the train west.

Power was 162 and 62....162 is smashed and DOA,CSX will drag it to their yard in Martinsburg later. 29 continued west with solo unit 62 at 9:10pm from Shenandoah Jct and will swap engineers at Martinsburg.Lots of repair work to be done on site,i.e. crossing apparatus,clean up corn,remove the truck,clean up 100+ gallons of leaked fuel,etc.

I wasn't aware there was a yard in Martinsburg.

Some mention was made of Pearson or West Cumbo,a yard crew was clearing up at that time and told to call the dispatcher before going home.

Hoping my fellow RR'ers are dealing with this well.  Also, 162 is the Kempf & Cella dedication (informally) unit.  RIP Brothers...

And RIP the AMTK 162.  It struck the big rig in its fifth wheel area at 65mph.  It is heavilly
damaged, everything on the pilot smashed, no lights, no windshields.  Fuel tank
ripped open, leaked perhaps a couple of hundred gallons of diesel fuel; a hazmat incident. 

Crew is OK, no passenger injuries.  Truck driver shaken up but OK. 

Location/time mp BA89.98, at 534pm.

Surviving unit AMTK 62 is not equipped with PTC.

Where do you think the MARC trains stat overnight and on weekends?

Cleared Port Clinton, Ohio at CD 256 at 0900.  62 running solo, no NS leader, confirmed with my own eyes.

The MARC yard is immediately west of the passenger station and former shop complex in Martinsburg.  This is where the MARC trains area stored.  The CSX yard which is known as Pearson Yard is a few miles further west, just east of West Cumbo near where the tracks cross over Interstate 81.  CSX uses Pearson Yard to serve the local industries in Martinsburg.  I believe it was originally constructed to service the former General Motors parts facility at that location.

Correct. I thought the thread was referring to the MARC yard by the old freight station.

Glad nobody was hurt. Taking out a big rig at 65 mph has got to shave years off your life expectancy.

Should keep Amtrak's legal dept. busy sueing all these truck drivers, who cannot seem to avoid trains at grade crossings............

Busy? Yes.  Successful?

Suing that guy in Nevada who killed a few people withi his stone hauler hasn't been an easy task.  A contract driver for a leasing firm who hired a  truck from somebody else to haul stone for a broker from a breaker site.  Lots of layers of insulation, but not many assets.

Markedly different facts of the case. The Nevada gravel truck driver failed to stop and slammed into the side of the train. The NTSB concluded that driver fatigue, inattention, and shoddy truck maintenance contributed to the wreck. There were six fatalities: the driver and five on board the CZ. Amtrak sued the trucking company for maintaining faulty equipment, for hiring the driver, and failing to adequately train and discipline same. The deceased driver's estate likely was "judgment-proof."

According to the news story, the driver at Bardane, WV stalled his rig on the tracks. Preventable, probably, but hardly rising to the same level of negligence.

OK,

My response was to the issue of Amtrak continuing to sue errant parties they believe to be at fault.  Truck and bus companies layer leases, ownership, contractors, etc so deeply that getting to a responsible party which also has money is nearly impossible

How much money has Amtrak collected in the Nevada crash?
