It probably won't survive the first lawsuit.

No affect on me until or unless Amtrak gets its s**t together and decides to be a business IN business instead of a junkyard going out of business.

The "American Justice" lady is from the trial lawyers assn.     I'm willing to bet they care about getting money themselves, a lot more than justice.

I, for one, am glad to see some push back against the sue happy nation we have become.    Blatent disregard for human life is one thing....but accidents happen.  That's why they're called accidents.  If I were killed on a train crash. I wou;ldnt expect my relatives to go suing everyone within 10 miles of the accident site, like some ppl do.   Its got nothing to do with justice...its just a big payday. IMHO

Daytime TV has a LOT of ads for legal services. Most run semi-legit to pure scam: mesothelioma suits, talcum powder causing cancer, various medical prosthetics, hair coloring...etc. And the related cash advance from structured payouts schemes. Grifters.

It’s a sad indicator of where this country is headed. Not that long ago you would watch daytime TV & see ads for programs for people who were trying to improve their lives/careers. Ads geared toward people who wanted to go back to school & earn a degree, become a dental hygenist, commercial driver, aircraft or diesel mechanic. Now it’s “dial 1-800-eight million to get the cash you need fast”, All while unemployment is at its lowest in decades to boot. Truly depressing. (and I’m not even from the generation who gets depressed about everything these days)

Most of those schools rely on student's getting grant money from the gov't. Few of the students will finish school, but the money's spent.

Unemployment figures are BS, and many people today have part-time/no benefit jobs.

Thank you.

Didn't Congress raise the per-collision limit for Amtrak's  total damage liability as a result of the Frankford Curve derailment?

Seeing how Amtrak is forced to pay out even if they aren't at fault due to various indemnity clauses with host railroads this is probably a good idea.

This sort of policy might be the first step towards restoring charters and special movements.

Honestly even if I was involved in an accident I would be reluctant to sue Amtrak.  It's like suing a church or non-profit whose services you rely on. I actually had the chance to collect legal damages from Amtrak once and I settled for my costs and $1000 in travel vouchers.  Someone in a similar position was able to extract $25,000.

By statute (FAST Act) the liability cap is now subject to an escalation clause--tied to the Consumer Price Index--and is revised every 5 years by DOT.

Here's a link to the Federal Register for the last time the cap was raised.
