He should have paid attention to the crossing signals. Hate to see anyone get hurt but, it was his own fault.   Here in the United States some lawyer would still file suit on the railroad hoping to hit it big.  Don't  know about Brazil.

The flasher mast almost looks like it has a bracket for a crossing arm.

That's because it does have a bracket for a gate.

After many accidents like this in crossing levels out there, VLI is instaling these new crossing gates, but they are not operational yet.

RR might want to think about turning or bagging the flashers until they are put in service to avoid any confusion to drivers. Not the fact that there was more than enough air flowing through the horn, some drivers totally rely on flashers and or gates, and some totally ignore them anyway.

I was wondering as it didn't appear that the lights were flashing unless it was the angle of the video camera.
Irregardless that is why here in the US we have instituted Operation Lifesaver programs in the schools with Drivers Education classes.

The RR crossing lights and gates were not working. In the US they have required that in any case where the lights and/or gates are not working the train crew must stop the train before fouling the crossing and proceed only after a member of the crew is on the ground and flagging the crossing.

As said before, the RR lights and gates are new in that area. We perceive that the motorcyclist saw the train and tryed to pass in front of it. It is a common thing here in Brazil: motorcyclists do not like to stop for trains or car at the crossing levels.

Sounds like bicyclers in the states. They can't be bothered by road rules.
