It seems this restaurant is owned by the guy that had the NBC series "The Restaurant". Wonder if he is paying UP a license fee to use the name?

Any restaurant name starting with "Mc" is targeted. I doubt Union Pacific Corporation would get very far in a lawsuit to compel Union Pacific the restaurant to change its name.
There's no overlap that could confuse customers, and I'd be very surprised if the Omaha HQ gets many calls asking about dinner reservations in NYC. The Sonic resto chain faced a similar challenge from a computer company a few years ago, and the case was laughed out of court. Nobody would confuse a restaurant with a software company... Of course, if UPRR had plans to open a national chain of restaurants with sexy railroaders delivering drinks, that could be different. They could call it HOGGERS. I wonder if HOOTERS would sue...
