Union Pacific Restaurant

I happened to find this site while doing a Yahoo search. It seems this restaurant is owned by the guy that had the NBC series "The Restaurant". Wonder if he is paying UP a license fee to use the name?

Even though this is in name, I believe one could successfully argue in a court of law that "Union Pacific" in name is a part of the brand identity of the Union Pacific Corporation and wholly owned subsidiaries. Case law would seem to favor Union Pacific Corporation. Consider what Sony Corporation did to a restaurant owner named Sony a few years back when she named her restaurant Sony's. Needless to say, it is NOT named Sony's.

Yes, he will likely be starting to pay after UP reads this thread.

Hey, he is a nice guy. Notice that his first instructions on how to get there is by TRAIN.

It looks like a real nice place. I hope our NY foamer friends can give him a try before UP gives him a trial.

McDonald's is the same way. McSushi in San Francisco was forced to change it's name after McD's found out. Any restaurant name starting with "Mc" is targeted.

The restaurant isn't using the livery, the shields, the reputation, or sharing the same business. I doubt Union Pacific Corporation would get very far in a lawsuit to compel Union Pacific the restaurant to change its name.

There's no overlap that could confuse customers, and I'd be very surprised if the Omaha HQ gets many calls asking about dinner reservations in NYC.

The Sonic resto chain faced a similar challenge from a computer company a few years ago, and the case was laughed out of court. Nobody would confuse a restaurant with a software company...


Of course, if UPRR had plans to open a national chain of restaurants with sexy railroaders delivering drinks, that could be different. They could call it HOGGERS. I wonder if HOOTERS would sue...

Did anyone look at the menu for this place? Its really out there. One of the luncheon sandwiches is House cured Gravlax
on Filone with Argula. I don't even want to know what that is.

So, in other words, no drive through? And you think us railfans would be interested in going, then?

I think he should've named the place "McCoca-Cola's at Union Pacific Plaza" and let the lawyers duke it out.

Yeah, but Chilean Sea Bass (Patagonia toothfish) is on the almost-endangered species so go easy. Order something else, like wild caught Alaskan/Californian salmon or tilapia or see the Monterey Bay Aquarium Seafood Watch website and order accordingly. Save our oceans!! :-)
