Eastern Railroad Discussion > CNJ Protests NS-D&H acquisition to STBDate: 12/13/14 02:46 CNJ Protests NS-D&H acquisition to STB Author: JPB To date, formal shipper and regional RR reaction to NS acquiring D&H South has generally been supportive (eg, Hanjin, P&W, RBM&N, M&BRR) but there have been some parties who have replied to the STB that this acquisition is not a "minor" transaction (SMART/Transport Union and CNJ Rail Corporation). Don't know much about CNJ Rail Corp but they also believe the transaction is anti-competitive for potential (not actual) waste/recycled glass business shipping from the Oak Island NJ area to northeastern PA due to loss of D&H's unexercised trackage rights over NS west of Oak Island. As part of the CNJ reply, the attached hand-drawn map was supplied.
OTOH, CNJ, per NS formal reply to the CNJ protest filing, is "...not a shipper, a rail carrier regulated by the STB, or a private operating railroad. Nor does it have any financial connection or standing with respect to the Transaction. Indeed, a review of prior STB cases and public records seems to indicate that CNJ conducts no actual rail operations or rail related business at all; certainly none connected to the Transaction..." Not trying stir any pots but I thought you might enjoy seeing CNJ's map doodle (most maps submitted to the STB are formal maps with hand-drawn annotations depicting proposed changes). Really, recycled glass traffic that doesn't even exist. Look at the address listed and its some posh house in the hills of Wachung, not anywhere near what might be considered industrial let alone rail access. The other question that came to mind is who owns "CNJ" reporting marks?
