       In order to have a possible Darwin award winner, the photo should also include the train. That way we 'know' and have something to compare to - in distance and closeness to the award itself.

       OR:  A photo of the car in numerous pieces taken right after this would work too. We ain't picky.

I think that both gates being all the way down is adequate.

closing statement "we can't let this Norfolk Southern Railroad come to Indiana and cause harms against innocent persons..
make the right decision on this case..."...

I've participated in civil trials as a juror and substitute the railroad's name with another defendant and that's what you'll
hear. What a crock...

The picture posted is a screen shot from the Chesterton, ID railcam looking west.  Is there a train stopped just out of camera view....or one approaching at 3 mph?  We don't know the facts or circumstances.  If you watched this railcam for a week, you could probably view several "snapshots" similar to this one.  It is always best to wear a life preserver of facts before you jump into the deep end of the opinion pool.

The gates could have been stuck in the lowered position for some reason with no train in sight.  I bet that you have had a Darwin moment in you past.

Possibly malfunctioning gates, looks like the driver has a nice wide view of anything that could be coming.

I was under the impression that all Western Indiana was was nice wide views...

As Cinder said you can watch that website and see morins doing what you see here as an Amtrak or stack train bears down on them at 60+ MPH.They just slow down and zig-zag through. And yes they have clear sight-lines to make the conscious decision to take the chance.

There was in fact a freight train approaching at speed, arriving at the crossing about 5 seconds after the car crossed. 

But here's another one.  Car making a left-hand turn around the back end of a stopped commuter, in a town (Ashland, VA) where trains do not blow the horn, and so the driver has no idea if anthing is approching from the north.  This from  Virtual Failfan camera, 7:15am today.

On closer inspection, it appears the crossing guard waved him through, even though he also CANNOT SEE if anything is approaching from the north.  If you have Virtual Railfan you can see it for yourself in the DVR playback section.
