Low Speed Grade Crossing Accident Cumberland, MD - 10 Nov 2018

While reversing into the yard at Cumberland, MD, the power from train Q277-09 struck a pickup truck that ran around the gates at the Knox Street Crossing.
Trailing locomotive, NS #9892 struck the pickup pushing the truck approx. 50 ft. damaging the switch machine for one of the Viaduct crossovers. 
Both locomotives were facing west and the movement was eastbound into the yard. 
No "life threatening Injuries" were reported to the driver of the Ford.

I would not want to have to explain that one to my insurance company. Of course, I'm assuming he/she had insurance. And a valid driver license. Probably too great an assumption.

CSX did a nice job of "popping the door" to gain access to the driver!  Hope they bill him for their efforts! As an FYI, where I am living, "popping the door" is a term we use for  using manual or powered hydraulic rescue tools to open a closed or damaged vehicle door to gain access to the occupants.

Be assured that some ambulance chaser lawyer will represent him and present several reasons why it was the railroads fault. The saddest part is if he gets a half decent attorney the railroad will probably choose to "settle" ( pay him some money to go away) as its cheaper than fighting in court.

   We had a drunk idiot climb up on the 614 when it was parked in Hoboken and get hit by the overhead electric which knocked him off the engine and set his clothes on fire. He suffered extensive burns and was in the hospital for 9 months and countless operations. 18 months later just as the trial was to begin NJ Transits lawyers settled with him and paid him $ 900,000.00 to go away. They said that the risk of going in front of a jury was too risky and that with all his crippling injuries there was a good chance the jury might award him millions due to his " pain & suffering".

   Now you know why insurance premiums are so costly.

Who will say that it wasn't the driver's fault here on Trainorders?  Anyone who drives around crossing gates that are down is committing a motor vehicle crime.  There are driving laws in this state and in this country and the problem is too many people do not obey them.  In the State of Maryland, one can usually make a right hand turn on a red light after coming to a complete stop.  How many times do we witness drivers making the turn without stopping or barley pausing?  Again, this is a violation of our traffic laws.  So I hope that this person gets a traffic ticket for going around the gates and that he/she has to have their insurance pay for the damages or it comes from their own pocket, whichever.  There are no excuses folks for this kind of behavior of directly breaking the law.

I've never seen anyone say anything remotely like that on Trainorders.  Perhaps you are confusing us with another site.  If not, would you please link to a post where someone said something like that?

And why railroads want to keep you off of their property and as far away as possible.
