Yes it is a maintenance issue, but not anything really unusual.
The cycle method of tie replacement always has enough good ties spread along the track to carry the loads over the inevitable decayed ties; the FRA safety standards recognize this.
A bigger issue is how did the parking lot get to be so close to the tracks?
In addition to trapping the water it looks like employees, customers, or others could inadvertently foul the tracks.
They really need a ditch to control the drainage, and that would appear to take a bite out of the parking lot/driveway.

Thanks for posting, looks like another day at work for many MofW employees, managers, and supervisors, going on for as long as there have been railroads.

in the FRA track maintenance procedures manual and no matter what railroad it is the BIBLE of track maintenance(Amtrak's is the MW 1000) has ONE thing that is the MOST IMPORTANT thing pertaining to track structure and that is "DRAINAGE" ... look in any BIBLE of track structure from the FRA to the smallest short line and "DRAINAGE" will always be the "FIRST" item in the manual ... it will also state "DRAINAGE" is the "MOST IMPORTANT" item when building and maintaining track structure ... poor drainage is the #1 reason for the breakdown in track structure ... drainage is considered an FRA defect and what FRA inspectors look for the most ...

as for the non secure right of way being that close to private property the railroad is no doubt in the crosshairs of a potential legal issues with a hazard situation whether it be human, property or both ... there should definitely be a defined protected perimeter to seperate and protect the 2 properties ...
