A municipal trash truck driver can hardly be called a over the road truck driver. Besides, for every truck driver that ignores a traffic law, there are probably hundreds of car drivers that do the same. There were multiple witnesses on the train and there should have been the forward facing camera.

Of course the locomotive camera would see the gates were down as the crossing is preceded by a curve, but would not see them activate. Local residents still say that the gates malfunction, at times being down with no train passing.

If the gates were frequently down with no trains approaching, the garbage truck driver, with frequent trips across the crossing, could have been lulled into a complacent sense "like the little boy who cried wolf"
