Winterail DVD's???
Author: PumpkinHogger

Wouldn't it be great if a guy could buy one?

Make them available as a fundraising deal, with the proceeds to go to whatever charity/museum/individual that Vic designates. For example, if a well-known fan has taken ill, that would be a superb way to support the guy.

Yeah of course they might get bits cobbed off to Youtube etc, but that has to be expected. Easy enough to shut those sites off, doubt it would hurt potential sales what with the video "quality" the net allows.

Wouldn't hurt attendance at all what the social aspect of the event.

After hearing how the show went this year, how the whiz-bangs possible with digital has made the presentations so much more watchable and enjoyable, I'd buy one.

Thoughts?

From what I know, it would not be possible because of the music. Vic has to get a special permit in order to play the music with the shows. And if he sold DVD's of it, he would have to pay royalties to all the different record labels and such. It would be great, yet probably not going to happen. Unless the laws on music change any how.

If it can be did for the shows then surely it could be did for a charity-purpose DVD.

Getting all that licensing might be possible, but it would probably be a hell of a lot of effort. And you'd have to persuade the music people that the money really was going to go to charity.

You don't have to deal with a bunch of record labels. You simply contact ASCAP, the American Society of Composers, Artists and Publishers, which manages the rights of music copyright holders and lays down the ground rules.

Music is copyrighted material. In essence, the use of such material in a money-making venture, whether a radio station, a DVD for sale, a bar/lounge, or Winterail, is subject to obtaining permission for its use and paying the appropriate license fee. For Winterail to be legal, there is a one-time license fee. As I recall, it's a rather nominal fee, but it absolves Winterail and the show producers of any problems arising from the charging of admission to hear a recorded work. You can read about all this on the ASCAP web site at http://www.ascap.com

Ever wonder why most chain restaurants, when celebrating a patron's birthday, instruct the waiters to sing a birthday greeting other than the traditional "Happy Birthday" song? It's because the restaurant doesn't want to pay ASCAP for use of the copyrighted song.

Distribution of music on DVDs and various other recorded media is a more complicated matter. It would still require the licensing of music, whether the DVD is distributed free of charge.

It is something that is paid for. Vic pays a one-day use fee. That is totally different than distributing the music for sale, in effect competing with the major labels on their home turf.

I would buy a video showing only the crowd at a Winterail show. But the soundtrack would have to have all the digestive effects as well for it to be any good. . . and thank goodness "smell-o-vision" hasn't been perfected yet. . .
