The Class 1s are in the business of hauling freight. Amtrak is in the business of hauling people. My own opinion is that Mr. Moorman should travel on Amtrak when practicable. However, using that plane for Amtrak business would look like a conflict of interest for NS to me.

At this point any consulting assignment with NS would be a conflict of interest. If Mr. Moorman is transported in the NS corporate plane for personal purposes, it would be taxable income to him. If he was transported in the NS plane for Amtrak business, it would be a cost billable to Amtrak. In the final analysis, if Mr. Moorman needs to be transported in a corporate type jet, it would be simpler to arrange his transportation through a charter service.
