No, it's not whether the Bob Evan's scramble being labeled as food violates the first amendment, and is possibly a crime against humanity...the suit is actually against Österreichische Bundesbahnen is liable after one their trains moved, without warning while people were boarding. An American women fell onto the tracks and lost both legs in the accident. The question revolves around whether ÖBB subsidiary (jointly owned with other European railroads) Eurail Group, an American Company, who sold the ticket, means ÖBB conducts commerce in the US. Previous decisions usually involving airline crashes say yes, that is commerce and ÖBB is likely liable. We'll see.

Several European rail companies (SNCF with Keolis, etc) also have extensive operations in the US.

While not rising to the hysteria of the "Sharia law in the US" nonsense, there's been discussion at the court about how much US law should respect / honor foreign law.

Edited to add:

The US is obligated by treaty to respect numerous aspects of foreign law.  Like marriages, some trademarks and patents, decisions by courts in criminal cases, etc. In some countries, but not in others.  We don't have to respect death sentences for insulting Islam or urging respect for marriage equality, and won't expatriate people to those countries. Just like most countries won't expatriate terrorists and others if they might face the death penalty in the US.
